Job Description

Reporting to the General Counsel to the Standing Joint Committee for the Scrutiny of Regulations, the Analyst (Legal Counsel) is responsible for providing legal advice to the Joint Committee on legal and procedural deficiencies identified in statutory instruments made by the executive branch.

The incumbent performs the following duties:

  • Appears before the Joint Committee to provide advice on novel and complex legal issues in regulatory law and to answer questions from members
  • Writes legal opinions for the client and applies the legal principles governing the exercise of delegated law-making powers, statutory interpretation and administrative law
  • Writes letters to government departments and agencies to advocate a legal issue or the resolution thereof on behalf of the client

Qualifications

Education :

  • Membership in good standing in a provincial or territorial law society combined with a Bachelor of Law / Juris Doctor degree from a recognized university

Experience :

  • Recent experience in drafting complex legal opinions in any of the legal fields across the federal landscape
  • Recent experience conducting legal research and analysis in regulatory law, statutory interpretation, administrative law, constitutional law and parliamentary law
  • Recent refers to experience that has been acquired within the last five (5) years

Knowledge :

  • Knowledge of the role and mandate of the Standing Joint Committee for the Scrutiny of Regulations
  • Knowledge of the federal regulatory process
  • Knowledge of administrative law and the legal principles governing the exercise of delegated law-making powers
  • Knowledge of legal methods, techniques and practices such as statutory interpretation and legal research (electronic and manual)

Asset Criteria :

  • Experience formulating advice and legal opinions and presenting them in a way suitable to a variety of audiences
  • Experience providing legal services in the public service, in private practice or in a parliamentary setting

Conditions of Employment :

  • A second-language evaluation (Bilingual staffing – imperative): CBC/CBC.
  • A successful pre-employment security screening.

Education and experience requirements will be used to determine which candidates will be asked to participate in the next stage of the selection process.
